The aim of the paper is that of discussing some recent antipositivist theses, with specific reference to the arguments that focus on the alleged incapability of legal positivism to understand and explain the complex normative structure of constitutional states. One of the central tenets of legal positivism (in its guise of “methodological” or “conceptual” positivism) is the theory of the separation between law and morality. On the assumption that in contemporary legal systems, constitutional law represents a point of intersection between (...) law and basic moral values, antipositivists contrast legal positivism with two main arguments. First, on a more general level, the positivist theory of the separation between law and morality is questioned; then, and consequently, the “neutrality thesis” in the juristic study of law is rejected. The article analyzes the social representations of ICTs’ appropriation for community empowerment by social movements. The study includes two recent Latin American student social movements: the Mexican #YoSoy132 and the Chilean student movement. Discourse analysis was used to examine interviews with participants in these social movements as well as other texts associated with their episodes of collective action. The discourse analysis was focused on four main dimensions of the social representations of ICTs’ appropriation: (1) the interrelationships between the technological and (...) the socio-political and cultural dimensions; (2) the tension between a visibility-centered and an articulating-focused use of ICTs; (3) the tension between the individual and the collective dimensions; and (4) the articulation between ICTs-based collective action and offline one. The findings indicate that the online/offline and the visibility/articulation tensions are relevant dimensions, in an articulated way, of the social representation of ICTs’ appropriation for collective empowerment. The results also indicate that the sociopolitical goals of the social movements are a central mediation for the process of configuration of the social representation, as it is proved by the importance of the individual/collective tension for the process. El objetivo de este artículo es criticar la representación tradicional del trabajo periodístico de Karl Marx, habitualmente olvidado por un canon engañoso que sólo asume sus artículos al precio de convertirlos en una obra menor. Uno de los problemas de esta concepción tradicional es que disocia sus contribuciones teóricas y económicas del desarrollo histórico del pensamiento del autor . Intentaremos señalar la importancia del periodismo maduro de Karl Marx en dos áreas: en la construcción de los conceptos centrales de su (...) crítica contra el capitalismo y en la producción de cartografías políticas para intervenir en el conflicto de clases. The ever increasing ability of medical technology to reshape the human body in fundamental ways—from organ and tissue transplants to reconstructive surgery and prosthetics—is something now largely taken for granted. But for a philosopher, such interventions raise fundamental and fascinating questions about our sense of individual identity and its relationship to the physical body. The aim of this thematic literature review is to explore nurses' perceptions of ethical issues in the care of older people. Electronic databases were searched from September 1997 to September 2007 using specific key words with tight inclusion criteria, which revealed 17 primary research reports. The data analysis involved repeated reading of the findings and sorting of those findings into four themes. These themes are: sources of ethical issues for nurses; differences in perceptions between nurses and patients/relatives; nurses' personal responses (...) to ethical issues; and the patient—nurse relationship. The findings reveal that ageism is one of the major sources of the ethical issues that arise for nurses caring for older people. Education and organizational change can combat ageist attitudes. Wider training is required in the care of older people, workplace skills, palliative care and pain management for older people. The demands of a changing global demography will necessitate further research in this field. (shrink)

The milestone category that is frequently used to refer to the COVID 19 pandemic is called into question to propose that the use of this category is rather what generates a distinction between a past time or a before and a future time or an after. It is proposed that the possibility that this has been erected as a milestone is given by processes that are maintained both globally and locally, even though what allows the appearance of unprecedented events for (...) the Chilean health system is precisely the need to articulate its actions and markedly neoliberal rationalities with global logics. It is specified in the penetration of technological and biopolitical frameworks in the ways of life of the population worldwide and in the notions regarding how to live, and in the colonial matrix of knowledge / power that is at the base of the historical conception of the world system. Boorse’s biostatistical theory states that diseases should be defined in ways that reflect disturbances of biological function and that are objective and value free. We use three examples from contemporary medicine that demonstrate the complex issues that arise when defining the boundaries of disease: polycystic ovary syndrome, chronic kidney disease, and myocardial infarction. We argue that the biostatistical theory fails to provide sufficient guidance on where the boundaries of disease should be drawn, contains ambiguities relating to choice of reference class, (...) and is out of step with medical processes for identifying disease boundaries. Although proponents of the biostatistical theory might regard these practical issues as irrelevant to the aim of providing a theoretical account of disease, we take them to indicate the need for a theoretical account that is adequate for current needs—including limiting new forms of medicalization that are driven by the identification of disease based on dysfunction. Our processes for determining the boundaries for disease need to recognize that there is no value-free method for making these decisions. (shrink)

Belief merging aims at combining several pieces of information coming from different sources. In this paper we review the works on belief merging of propositional bases. We discuss the relationship between merging, revision, update and confluence, and some links between belief merging and social choice theory. Finally we mention the main generalizations of these works in other logical frameworks.

This special issue aims to spotlight the individual, lived experiences of caregivers and those receiving care–areas often overshadowed by clinical and medicalized narratives within clinical ethics. Our aim is to enrich the discourse by incorporating stories and narratives of medical care and challenge existing clinical practices by emphasizing patient and practitioner experiences. Through a blend of clinical and academic insights, this issue provides phenomenological narratives, highlighting the importance of lived experiences in understanding and improving clinical caregiving practices. Originally published in 1937 during the Spanish Civil War, the country was split into pro-fascists and pro-communists, the author felt that the conflict in Spain threatened to develop into an international war, perhaps an international civil war since the issue cut across frontier lines. The situation had no parallel at the time. The author looks back to wars of the sixteenth century to find a precedent for this dramatic duel between two political conceptions. Using examples from Europe including the conflict (...) between Catholics and Protestants he shows that, as in England who led their own way at the time, there are alternative solutions and hopefully a way to find a middle ground. In this essay, I argue that to create a genomics that offers more gifts than weights, central attention must be paid to questions of justice. This will require expanding bioethical imaginations so that they grasp and can respond to questions of structural inequity. It will necessitate building novel coalitions and collaborations that turn the attention of bioethical governance away from narrow individual questions such as, “Do I consent?” and toward the broader collective question, is this just? What kind of lives (...) and collectivities are made possible? What rights and principles should govern them? The essay ends with one example of this novel coalition building arising from the Science and Justice Research Center at the University of California, Santa Cruz. It draws lessons from this effort to build new alliances that bridge the social sciences and natural sciences, arts and engineering, to create new kinds of training and thinking that create a genomics that more adequately responds to fundamental questions of justice. The Greek word eoikos can be translated in various ways. It can be used to describe similarity, plausibility or even suitability. This book explores the philosophical exploitation of its multiple meanings by three philosophers, Xenophanes, Parmenides and Plato. It offers new interpretations of the way that each employs the term to describe the status of their philosophy, tracing the development of this philosophical use of eoikos from the fallibilism of Xenophanes through the deceptive cosmology of Parmenides to Plato's Timaeus. The (...) central premise of the book is that, in reflecting on the eoikos status of their accounts, Xenophanes, Parmenides and Plato are manipulating the contexts and connotations of the term as it has been used by their predecessors. By focusing on this continuity in the development of the philosophical use of eoikos, the book serves to enhance our understanding of the epistemology and methodology of Xenophanes, Parmenides and Plato's Timaeus. ABSTRACT We consider in this work the problem of iterated belief revision. We propose a family of belief revision operators called revision with memory operators and we give a logical (both syntactical and semantical) characterization of these operators. They obey what we call the principle of strong primacy of update: when one revises his beliefs by a new evidence, then all possible worlds that satisfy this new evidence become more reliable than those that do not. En este artículo se traza una distinción clara y precisa entre geometría pura y geometría aplicada dentro del marco de las reflexiones sobre los fundamentos de la geometría promovidas por la aparición de geometrías no-euclidianas y en el contexto de las discusiones mantenidas por los empiristas lógicos sobre la estructura general de las teorías empíricas. De manera más particular, se defiende, tal y como proponen los empiristas lógicos, que una geometría pura es un sistema formal que no nos dice nada (...) sobre la realidad física, mientras que una geometría aplicada es una teoría empírica, una teoría física (una teoría del espacio) que resulta de dotar de significado a una geometría matemática. Para sostener esta tesis se recurre, en parte, a ciertas ideas expresadas por Einstein sobre la teoría general de la relatividad. Por último, si bien parece que esta imagen de la estructura de una geometría física es relativamente adecuada, se insiste en la tesis de que el error principal de los empiristas lógicos estaría entonces en pretender hacer de ella el carácter predominante de la estructura de las teorías científicas en general. Does the real difference between non-consequentialist and consequentialist theories lie in their approach to value? Non-consequentialist theories are thought either to allow a different kind of value (namely, agent-relative value) or to advocate a different response to value ('honouring' rather than 'promoting'). One objection to this idea implies that all normative theories are describable as consequentialist. But then the distinction between honouring and promoting collapses into the distinction between relative and neutral value. A proper description of non-consequentialist theories can only (...) be achieved by including a distinction between temporal relativity and neutrality in addition to the distinction between agent-relativity and agent-neutrality.
